DMCA Policy

Avocado Caesar Salad Vegan Paleo ("we," "us," or "our") respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act (DMCA). This policy outlines the procedures for copyright owners to notify us of alleged infringement and for users to respond to infringement allegations.

As a service provider under the DMCA, we will expeditiously remove or disable access to material that is claimed to be infringing or the subject of infringing activity. We also have a policy of terminating, in appropriate circumstances, users who are repeat infringers.

Filing a Copyright Infringement Notice (DMCA Takedown Notice)

If you are a copyright owner or an agent authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our website or services, you may submit a written DMCA Takedown Notice to our Designated Copyright Agent with the following information:

  1. Identification of the copyrighted work claimed to have been infringed: Please provide a detailed description of the copyrighted work(s) that you claim have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material claimed to be infringing: Please identify the specific URL(s) or other location(s) on our website or services where the material you claim is infringing is located. Sufficient information to allow us to locate the material is required.
  3. Your contact information: Provide your full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief: Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you have the right to file a Counter-Notification. When we receive a valid Counter-Notification, we will forward it to the party who submitted the original DMCA Takedown Notice. If the complaining party does not inform us that they have filed a court action seeking a court order to restrain you from engaging in infringing activity within 10-14 business days of receiving the Counter-Notification, we may restore the removed material.

To file a Counter-Notification, please provide our Designated Copyright Agent with the following information:

  • Identification of the material that has been removed or to which access has been disabled: Please provide the URL(s) or other location(s) where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury: Include a statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number: Sufficient contact information for us to reach you.
  • A statement of consent to jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Avocado Caesar Salad Vegan Paleo may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature: A physical or electronic signature.
